Important: Please read these rules before entering the FotoMagico Slideshow Showcase sponsored by Boinx Software (the "Sponsor"). By entering the Showcase, you agree to be bound by these Official Rules.
NO PURCHASE NECESSARY TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF BEING SHOWCASED.
1. How to Enter: To enter the FotoMagico Showcase ("Showcase"), complete the Official Entry Form and submit it. Your slideshow entry can be posted to your personal web site, then send the download link to: derrick AT thedigitalstory DOT com ("Entry Notification Email") with the subject line "FotoMagico Slideshow Showcase Entry". You can also use alternative free upload services such as DropSend or YouSendIt. You can also post the entry to your .Mac iDisk Public Folder and send in your .Mac user name. The Slideshow Entry must be received by 12 Midnight PDT on June 15, 2006. Indicate method of submission on the Official Entry Form. Names, email addresses and other contact information obtained through the contest may be used to notify the participants of the contest results. Entrants may submit as many slideshows as they wish, but must complete a separate Official Entry Form for each submission.
2. Showcase Selections: All entries will be judged by The Digital Story staff and up to ten (10) entries will be selected and showcased on The Digital Story site. Judging decisions will be final and binding on all matters relating to the Showcase.
3. Entry Qualifications Each entry must be between 1 and 4 minutes in duration, displayed at a maximum of 400 pixels in either width or height. 320 x 240 are the recommended dimensions. Entries may include audio, but a soundtrack is not required. The entrant must own the copyright, or have explicit written permission to use, all of the content in the entry, including pictures, video, music, audio, or any other element.
4. FotoMagico Slideshow Software Entrants who wish to use FotoMagico slideshow software for their entry may purchase the software for a reduced price using discount code: "Digital Story". Software may be purchased at the Boinx Software order page and select "FotoMagico". Once the code is input and the Checkout button is clicked, the $10 discount will be reflected in the final order total page. NO PURCHASE OF SOFTWARE IS NECESSARY TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF BEING SHOWCASED.
5. Showcase Benefits Each entrant selected for the showcase ("Featured Entrant") will have his/her slideshow featured on The Digital Story. Entries may also be featured on the FotoMagico web site at the sponsor's discretion. Each Featured Entrant will have his/her bio (from the Entry Form) accompany the slideshow and a link to his/her website (from the Entry Form). Featured Entrants will also be included in a Showcase Press Release distributed by The Digital Story and Boinx Software.
6. Winner Notification: The Featured Entrants will be notified by e-mail. Sponsor is not responsible for changes for any change of e-mail address.
7. Sponsor and any of its respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees, and agencies will not be responsible for (1) any late, lost, or misrouted entries or errors in transmission; (2) any disruptions to Internet connection, injuries, losses, or damages caused by events beyond the control of Sponsor; or (3) any printing or typographical errors in any materials associated with the Showcase.
8. Sponsor and its agencies are not responsible for technical, hardware, software, or telephone malfunctions of any kind and shall not be liable for failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications utilized in this Showcase which may limit the ability to participate in the Showcase. If for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Showcase, the Showcase is not capable of being conducted as described in these rules, Sponsor shall have the right, at its sole discretion, to suspend, modify and/or cancel the Showcase.
9. Eligibility: Showcase is open to anyone over the age of 18 at the time of entry. Employees of Sponsor, its subsidiaries, divisions, and related companies, and their respective agencies and agents and immediate family members of such are not eligible.
10. BY ENTERING THE SHOWCASE, PARTICIPANTS RELEASE SPONSOR AND ANY OF ITS RESPECTIVE PARENT COMPANY, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENCIES (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY LIABILITY WHATSOEVER, AND WAIVE ANY AND ALL CAUSES OF ACTION, FOR ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SHOWCASE OR ACCEPTANCE, POSSESSION, USE AND/OR MISUSE OF ANY PRIZE (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES, AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT, WHETHER INTENTIONAL OR UNINTENTIONAL) WHETHER UNDER A THEORY OF CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE, OR IMPUTED), STRICT LIABILITY, PRODUCT LIABILITY, CONTRIBUTION, OR ANY OTHER THEORY.
11. Except where prohibited by law, entry into the Showcase constitutes permission to use winner's name, likeness, and/or showcase information, without limitation, for any advertising, promotional, trade, or any other purpose, without further compensation to, or permission from, the Featured Showcase Entrant.
11. Winner's List: For the names of the Featured Showcase Entrants, send a self-addressed, stamped envelope to The Digital Story, P.O. Box 1101, Santa Rosa, CA, 95403.. Requests must be received within sixty (60) days from the end of the Showcase Period and will be shipped when all Featured Entrants have been notified.
12. The Showcase will be governed, construed, and interpreted under the laws of the United States. Entrants who violate these Official Rules, tamper with the operation of the Showcase, or engage in any conduct that is detrimental to Sponsor, the Showcase, or any other entrant (as determined in Sponsor's sole discretion) are subject to disqualification. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Showcase, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Santa Rosa, California.
